In the lawsuit filed by diamond distributor Lazare Kaplan International against PhotoScribe Technologies Inc., a New York-based manufacturer of diamond laser inscription equipment, and the Gemological Institute of America (GIA), the decision has been in favour of the accused. This is a second patent infringement lawsuit brought by Lazare Kaplan against the accused. %% The two patents in the suit - US Patent Nos. 6,476,351 and 7,010,938, pertain to diamond laser inscription equipment and inscribed diamonds, respectively. They are assigned to Lazare Kaplan. %% The New York district court announced its decision on May 2, in which Lazare Kaplan was guilty of ‘inequitable conduct’ before the US Patent & Trademark Office in obtaining the two patents-in-suit. Lazare Kaplan was investigated as having withheld material prior art with deceptive intent, which in effect renders both its asserted patents unenforceable.
